Sounds like you were charged with a class B misdemeanor. Usually, that means you resolved the case in one of Utah's Justice Courts. That said, you can appeal, as long as, 30 days have not elapsed from the day of sentencing. If more than 30 days have elapsed since you have been sentenced, you cannot appeal. Hope this helps.

First, it is never good to delay going back to Court because you have a bench warrant. You can be arrested at any time: your home, your job, or at school etc. Because you did not have the money for some time, you can argue that you did not have the ability to enroll in the DUI school, and get the OK to re-enroll in classes, & complete your Probation requirements. Go see an experienced attorney to help you get back into the good graces of the Court.

What stage are the proceedings at? Are you waiting to go to trial? Have you already been convicted? If you have not been convicted, you cannot file motion for ineffective assistance of counsel, and there probably is no transcript. If you have been convicted, then you maintaining the accusations are false means nothing because the judge or jury have spoken.
