Can a person''s criminal history be used against them when the conviction comes out of another state?

George Lawrence Sandefer
Answered by attorney George Lawrence Sandefer (Unclaimed Profile)
Criminal Law lawyer at Sandefer Law Firm
Unfortunately, in Florida any criminal record from any other state can be used in sentencing. Florida has a punishment code where each prior conviction has a score depending on the charge.  If there is not an exact match Florida uses the one closest to add a score.

No, you cannot get a vop dismissed unless there are grounds to dismiss it, and there rarely are. You need to hire an attorney in FL.
