Can I get a DUI while driving on private property?

Answered by attorney Mark Arneson
Criminal Law lawyer at Arneson & Geffen PLLC
Under Minnesota Law, you can be charged with a DWI even if you are driving on private property. However, the facts in your case are very suspect, unless you actually told the officer you were driving. This is something you should fight.

What can we do to prevent jail time after my husband was caught with a gun as a felon?

Answered by attorney Lucio Antonio Montes (Unclaimed Profile)
Criminal Law lawyer at The Montes Law Firm
He can be sentenced to the max of ten years, although highly unlikely. If he has not already hired a criminal defense attorney, he should. The attorney might be able to ask for a deferred adjudication. Your husband is not likely eligible for a straight probation. There are too many variables to account for with the limited information. You should consult with a local criminal defense attorney.

How do you get your records expunged? What are the legal criteria to have records expunged?

Answered by attorney Lucio Antonio Montes (Unclaimed Profile)
Criminal Law lawyer at The Montes Law Firm
You must petition the District Court of the county where you were charged with the offense. The criteria is set out in Chapter 55 of the Texas Code of Criminal Procedure. Generally a person can expunge a case where the person was acquitted (found not guilty), the case was dismissed, or a court of appeals overturned a conviction. From your broad question, it would likely be best if you consulted a local criminal defense attorney. Good luck.
