What will happen or will I be granted bail or bond if PO violated me?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
It depends upon how serious the violation is, and this question is pretty confusing as to what the violation is. You have to give enough information for me to formulate some sort of opinion. Attorneys need to know all the relevant facts, and that is one problem with seeking free advice on internet forums, people rarely give us enough of the facts we need to know. The usual, as far as I am concerned, warrant for violation of probation, is usually a no bond warrant, and you have to get the bond set by the judge. That requires a hearing, and you could be in jail until the hearing.

MY SON HAS BEEN EXONERATED IN A CASE WITH A CODEFENDANT DO HE HAVE TO BE IN COURT WHENEVER THE CASE IS CALLED UP ?

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
First, you need to be aware that a co-defendant who takes the blame or responsibility for some criminal act does not, in and of itself, exonerate your son.  Someone else taking the blame or responsibility does not, in and of itself, constitute exoneration under the law.      If your son received either a notice to appear in court (either in the mail or in person) or a subpoena to appear, he must be present.  I suggest you check with the Clerk of Court to make absolutely sure -- since sometimes it's easy to miss or overlook a notice that comes in the mail.  If he was sent (or, otherwise, received) either a notice or subpoena to appear, he must be there.  Otherwise, a capias for his arrest will most likely be issued by the judge. It might be possible for his attorney to waive his presence -- but you must check ahead of time with the attorney regarding whether this can be done -- and, if so, the procedure and requirements for doing it.  However, I am assuming that he does not have an attorney or you would have known the answer to your question already.

How much of the parolee's home can be searched?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
The whole place can be searched by cops with a warrant. The whole place will probably be searched without a warrant, but by a probation officer. The outcome of any case depends upon its own facts and the law, as well as the particular likes and dislikes of the judge and the abilities of the attorneys. Get one now, before it is too late. At least go and speak with one about this, so that you know what can and cannot be done. The gist of the situation is that there should be no crimes whatsoever committed on the premises or about them. There should be no guns there, and there should be no controlled substances.
