It sounds as though you have a very defensible case. You need to hire an experienced defense lawyer quickly, who may be able to persuade the assistant state attorney to forego filing charges. The lawyer will be able to see the police report and witness statements and should obtain the videotape via subpoena. If you're only charged with a misdemeanor, the lawyer should ask the court to permit depositions of all witnesses. Discuss with your attorney the merits and ramifications of filing a criminal or civil case against the aggressor.

It depends on the offense(s) that were committed (if they are misdemeanors the offer to pay the fines in full is generally sufficient, but felonies can be a different story). The attorney can usually have more success in negotiating with the court personnel and the proscutors in a situation such as this. However, the disclaimer is that the final decision on whether any jail time is going to be served rests with the judge.
