You could be convicted if the judge or jury believe you were in constructive possession of the drugs. That means that you knew where they were and had reasonable access to it. It is not uncommon for charges to be brought against everyone in a household or vehicle where drugs are found. The habitual criminal statute is a close cousin to the 3 strikes law from California that we hear so much about. It does not implicate double jeopardy since you are not being charged for the same offense once more, rather, your prior convictions are being used to enhance your sentence. The law has been subject to challenges on 8th amendment grounds, but as long as the public and the legislature acquiesces to its existence, I doubt its going anywhere.
