You can have the arrest and/or charge expunged six months after the completion of the PTI period. You can then answer that you have never been arrested or charged. We do these expungements each week. The cost is $1500. Ed Dimon 732-797-1600

About Indictments

Edward J. Dimon
Answered by attorney Edward J. Dimon (Unclaimed Profile)
Criminal Law lawyer at Edward J. Dimon
The prosecutor has the authority with the grand jury to present your case for a second indictment. We often do not object to an indictment in that our objection sets forth the problems with the present indictment and the prosecutor is educated by our objection. The prosecutor addresses the problems and obtains a second indictment without the problems. Please call if we can help.

Is it legal for police to take possession of vehicle for an open container and distributing to a minor when the owner of the vehicle is present?

Answered by attorney Austin M Hirschhorn (Unclaimed Profile)
Criminal Law lawyer at Austin Hirschhorn, P.C.
If a motor vehicle is used in the commission of a crime the police can take possession of the vehicle and possibly search it if there is probable cause for them to do so. The fact that the owner of the vehicle is present does not limit the authority of the police.
