What happens if I accidentally missed a court date for a DUI?

default-avatar
Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
When you miss a scheduled court date, the judge issues a warrant for your arrest. If you have no criminal history then it is doubtful that the police will actually come to your home and arrest you. You need to contact the court to get the hearing rescheduled. The court will tell you how to do it. You may want to have an attorney assist you with this. It is serious to miss a court date.

If someone is handcuffed do they need to be read their Miranda Rights?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
Enough fora dismissal? No. Handcuffs are at a minimum detention, but maybe not arrest. Miranda rights only need to be read if the person is being asked questions about the crime. No questions, no Miranda, no problem.

What can I do if my attorney does not contact me?

Answered by attorney Seth David Schraier
Criminal Law lawyer at Law Office of Seth D. Schraier, P.C.
It depends on whether the attorney is a public defender or a hired private attorney. If it's a private attorney, then you can change attorneys at almost any point during your case. If it is a public defender, you have to ask the judge to assign a new attorney to you, which is not guaranteed to occur. How long is the attorney taking to get back to you? Some defense attorneys can be in court all day and unable to answer any phone calls.
