Without facts it is hard to give any solid answer. The SOL for perjury in FL is probably 3 years. I do not know the law in NY. Your question is confusing, but to try to answer, if there is a 3rd degree felony, the punishment can be up to 5 years in prison, and for 2nd degree felonies it is up to 15 years. However, filing a false police report is a 1st degree misdemeanor, with a maximum penalty of 1 year in the county jail. You see, without the facts all we can do is give general information.

Free attorneys are hard to come by. If your dad is indigent then he may be able to get a court-appointed lawyer but he has to ask the judge for one. These guys are not free however. Their rates are very low and payment may take time but they must be paid.
