An Additional $40,000? I don't know the details about the case, but that certainly seems pricey. What did your original retainer consist of, a flat fee or hourly rate? Are the additional counts part of the same Complaint? or is there a separate complaint that has the other charges. A retainer that goes until a certain date (as opposed to a certain part of the Court hearings (ie. through preliminary, through trial...etc) seems odd. I am sure there is a lot more to this story, but based on what you wrote, one option would be to hire another attorney that may be more in your price range.

You may be sentenced to prison, or you could get probation and some county jail time. Without more facts I cannot be more specific. It may be that the burglary and 496 are for the same property and if that is true you could only be sentence d on one of the those 2 counts.
