What is likely the outcome at the court for a First offense, driving without a license?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
A first offense driving while license suspended (DWLS) is a 93-day misdemeanor with fines, costs, and additional driver's responsibility fees. More than likely he is facing probation for just a first offense but that also depends on the judge. Consult with an attorney in your area to see what the best possible deal is for your husband.

Is it a legal arrest when they failed to read my Miranda rights?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
It may well be. Miranda right are only required if an officer is going to start questioning you. If he/she does so without Miranda being read, then the information obtained may possibly be suppressed. If the info is suppressed and the case cannot be made without this info, then the case may go away. The arrest is still legal, it's just the case may not be able to go forward. You need to hire an attorney to help you with this.

Is there a statute of limitations on money owed to a state on a felony conviction or is it until death do you part?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
There is no statute of limitations owed, because statute of limitations involves the state bringing charges, not collection of money.
