The Plain View doctrine is a well-settled area of search and seizure law. It basically states that anything the officer sees in plain view is fair game, as long as he views the items from a vantage point that he is legally entitled to be at. Your friend needs to sit down if a criminal defense lawyer and go over the police reports to see if the officer's actions were legal.

Technically, once you are arrested your Miranda rights are supposed to be read to you. The police can ask you whatever they want, however, you don't have to answer them. Legally, any voluntary statements you make may be admissible.
