In NY you do not go to jail because you appealed a ruling.  In NY the appeal in a criminal case is after the defendant is convicted and sentenced.

He is looking at credit card fraud and theft, both felonies. You should try through plea bargaining to try and get a deferred judgment for him so he can avoid a felony conviction if he completes probation. However, the penalty ranges for those charges could be from 2-6 years in prison.
