There are a lot of facts here that would make good fodder for mitigating and defending your case. I would suggest getting a lawyer to assist you in presenting your case.

Can I get the violation dismissed? How?

Answered by attorney Ezra N. Goldman
Criminal Law lawyer at Law Offices of Ezra N. Goldman P.C.
I would say no, you can not. You can tell this excuse to the judge and see if he will accept it. You might have asked the probation officer to see your mother in law who had a stroke before you got violated. If you were not in Monroe when the crime occurred, you should not have plead guilty. Now that you did, no one will listen to your claim of innocence.

What can I do on a theft charge to not go to jail and have it on my record?

Based upon the amount you stole, it could be filed as a felony. Your best bet to work this out is through an attorney. If you can't afford an attorney you probably qualify for a public defender. Ask for one. Don't try and do this on your own.
