If I paid for my friend's bail, and he happens to pass away, do I get my bail money back?

If you posted the bond directly with the court, you should get your money back. Bail is intended to assure a defendant's appearance at court proceedings in a criminal case. When a defendant dies while the case is pending, the case is dismissed. When the case is dismissed, the bond is "discharged." That means, the bond is terminated. If the bond was paid in cash to the court, the funds will be returned. If the bond was posted by securing real property, such as a residence, the property will be released. However, if you used a bondsman to make the bond, and only paid him a premium such as 10 or 15% of the bail amount, and didn't provide collateral for the rest, the bondsman will keep the premium upon your friend's death, just as he would if the case ended with acquittal or conviction. If you also gave the bondsman money as collateral, over and above the premium, that amount should be returned.

Do not let him talk to police or other investigators until and unless a lawyer defending him agrees your son should be eligible for a public defender - apply and trust the attorney the girl may have no consequences - I know that does not seem fair, but the point it to concentrate on your son?s situation there should be a way to end this case without a long lasting consequence - diversion may be available.
