My liscense was suspended for lapse of ins. Then I got tickets for speeding and driving on a suspense liscense. Where do I start to fix this?

Scott Glen Cerbin
Answered by attorney Scott Glen Cerbin (Unclaimed Profile)
Criminal Law lawyer at Scott G. Cerbin, Esq., PLLC
If you could get the lapse rescinded it would avoid the mandatory 1 year license revocation and fines associated with the no insurance ticket.  Talk to your insurance company.  The driving on suspended license is called Aggravated Unlicensed Operation (VTL 511.1) and it is a misdemeanor which is usually plead down to the traffic infraction of unclicensed operation.  You need a criminal lawyer!

What happens if I accidentally missed a court date for a DUI?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
Different counties treat it differently, but you probably have a warrant out for your arrest. If this was just in the last 2 days, a call to the court clerk may prevent a warrant from issuing. If it is beyond 2 days, the warrant has issued. If you were on bond prior to missing your court date, call your bondsman to try to help you fix this. If you were not on bond, you should call a bondsman to help you get bonded out when you turn yourself in. The court can enter a judgment on the DUI against you. You need to contact the court to say that you do not want this to happen. You have about 7 days. If you have an attorney (public defender), contact him/her. If you do nothing, eventually they will arrest you.
