Can the owner of a household be penalized if a resident has drugs?

I cannot categorically say that the owner cannot, or will not, be "penalized" (do you mean charged with a crime?) if a resident has drugs. Obviously, it depends upon the specific circumstances of this situation. Two people can surely be charged with possession of the same narcotics. On the other hand, if the drugs were your resident's, then you should not cave in to any plea bargain, or even accept Drug Diversion (PC 1000), just because you are eligible. Make the District Attorney prove it!

What is your question? I do not think you will be able to remain in the country because you plead to a felony, which immigration will treat like an aggravated felony, which means you may not be able to be adjusted. So, you spent money on college rather than the attorney, only to be deported. That made no sense.

What reasons would the judge and prosecuting attorney not receive up to 3 motions to dismiss?

This is very difficult to follow. What do yo mean by "received"? It says your attorney filed three motions to dismiss but they were not "received" by the judge or the DA. This is confusing. When a motion is filed with the court, the judge automatically gets it, and the court requires proof of service that the motion was served on other parties (i.e., the DA). So if the motion was ever filed, then everyone "received" a copy, unless you mean something different by "received". Your best move would be to discuss this with your lawyer, who will obviously know what is going on, rather than ask attorneys online to guess as to what's going on.
