It depends on the type of case and the agreement you reach with the attorney you choose. In many cases, the retainer is based on a number of court appearances. That is, you may pay for a number of court appearance up front and, if you do not need to appear more than what you've paid for, there are no additional attorney fees. This is particularly true in criminal cases and does not typically include a trial fee. In other cases, you will be paying hourly for the legal work, but the fees are first billed against the retainer. I've handled cases where the retainer covered all of my hourly fees but others where I've billed for fees over and above what the initial retainer covered.

You need to mair a written record of what happened. You should have your attorney speak with the judge's clerk to get the judge's thoughts. This is a difficult case to win.

The police conducted an illegal search and you should file a complaint with the police chief. Keep a voice activated tape recorder out of plain view in your car so that a record will be kept if it happens again. Arkansas is what is known as a "one-party" state where as long as you are a party to the recorded conversation it is legal and can be used as evidence. Document with pictures and witnesses any interactions with the police. Police harassment and misconduct is illegal, if you have proof you can bring what is known as a Section 1983 law suit against the officers and the department of they fail to stop the misconduct.
