When you leave your phone, you leave yourself exposed. Let us assume that the photos were posted on-line. How will your friend prove that her ex did it? The posting was made from her phone. So, it will just be her testimony that she left her phone and HE DID IT. IF he denies ever doing it. It is just her word versus his word.

You may be eligible for a diversion program which would keep the matter of your public record. Also, if you have no priors then you can probably negotiate it down to a misdemeanor with no jail.
