You might be charged with new offense, but not the same crime. If you committed aggravated assault and the person has now died, you can be charged with felony murder.

It is probably not possession, but it could still be theft if his record is clean, its unlikely he would get a jail sentence, but he may end up with a criminal charge - likely misdemeanor.
