Graves Act violations are very serious and result in incarceration unless there are ' mitigating circumstances' or 'cooperation'. the county prosecutor has wide discretion regarding both 'graves' and 'PTI'. these statutes are 'tools' of the prosecutor. they are not within the judge's discretion. i was the First Assistant Prosecutor in ocean county anew the prosecutor required incarceration for 'graves' unless there were significant 'mitigating' circumstances. ed dimon, esq. 732-797-1600

You need to let the DA and court know that you intend to plead self defense. You should have an attorney to do this correctly. You must give prior notice of the intent to use the defense of self defense.

I would think seriously about 'defending' this 'shoplifhting' charge with an attorney. We do many 'shoplifting' cases and the national chains do not want to settle and they pay large amounts of real estate taxes to the community. As such, they are listened to. Please call.
