Dealing in Stolen Property can be a Second Degree Felony with a 15 year statutory maximum. It is a level 5 offense meaning she on that charge alone does not score mandatory prison time. Level 5 primary offense is 28 points. If you have over 44 points the Judge usually has to sentence you to prison. If they charge her with a Third Degree Felony then her statutory maximum is five years and it adds points to her score. If she is on probation she could get the statutory maximum on that. So it depends on what she is finally charged with by the State, what she pleads to and what her prior record is. Normally a first time offender would get probation with those charges. However, if she is violating probation she may be looking at a short jail (under one year) or a short prison sentence.

Sounds to me like your spouse may be eligible for something called "cancellation of removal" for non-lawful permanent residents. I base this suggestion on your husband's long duration of residence in the US and the hardship I am sure you will suffer if your spouse is deported. My suggestion is that you employ the services of a competent and licensed attorney. There is a lot that can go wrong if the case is not handled correctly.
