Your brother is in serious trouble if his probation was for a felony. Even if not, he's still in a bit of a bind due to how probation warrants work (there is often times no bond). If it can be proven he had no knowledge of the drugs, he may be better off, however he'll still have the DWLS charge to worry about.  He should consult with a criminal defense specialist immediately.

There are too many variables to answer your question.  It will depend upon where (i.e., the county) in which the offense occurred.  That's because the prosecutors and judges in different parts of the state respond differently to such circumstances.  Even if the county were known, it still would not be possible to tell you what to expect since the individual prosecutor, judge, and defense attorney would have an impact on the outcome.  Also the facts surrounding the alleged crime would have an impact.  (However, my best advice is that you should not divulge the facts of what happened to anyone other than your attorney.  Remember, you have a right to remain silent.)  In the areas where I primarily practice, the more extensive prior record you have (even if they are all misdemeanors), the more likely it is that the state will ask for jail time -- and possibly probation. There, also, are numerous other factors that can influence any proposed sentence.  So I recommend you have an attorney, who is familiar with the court system where you're going to court, represent you.

This is a matter for the local prosecution attorney, make your complaint there. It is criminal, not civil manner unless you are seek damages from your ex-wife which is a different matter.
