Why does my arraignment keep getting pushed back?

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
There are various reasons why arraignments are sometimes "pushed back."  If you are represented by an attorney, you should ask your attorney for an explanation. Sometimes an attorney will push an arraignment back to give the attorney more time to negotiate a plea bargain early on the case.  Some prosecutors have a policy of making their best offer before arraignment -- and increase the offer after that. It's possible the State may still be investigating the incident and not prepared to proceed until it gets more information from the alleged victim.  Then the state can decide whether it wants to proceed at all; or, if it decides to proceed, whether to proceed with the charge as a misdemeanor or as a felony. So I cannot tell you what reason exists for your case being pushed back.  These are just a couple of the more common reasons.

Can I open up a case that was dimissed 5 years ago?

Answered by attorney Harley Ives Gutin
Criminal Law lawyer at Gutin Wolverton
Yes. However, it is hard to accomplish and will be done only under unique and rare circumstances such as newly discovered evidence.

What can I do to get the case file?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Criminal Law lawyer at R. Jason de Groot, P.A.
What you can do is ask the clerk to send you copies of the entire file, or go to the clerk and have copies made. What you have said here does not indicate that the attorney did anything wrong. So, you need to come up with a lot more than what you wrote here. Get copies and take them to another criminal defense attorney who has many decades of experience. Also get a complete transcript of the trial, including the jury selection. Then, the attorney will be able to see whether there might be any post conviction relief available to your son.
