A 13 year old lacks the legal capacity to consent to this sexual arrangement; period. The rape charge will probably not succeed because of the documented emails; however, he has committed Carnal Knowledge Of A Juvenile, and I think that carries a possible jail sentence of up to five years.

The operative period of time is when the incident occurred. You are being sued because it is claimed that you were somehow legally responsible for what happened. If you were, then liability can be assessed against you. The fact that circumstances have changed since then does not change the liability as of the time the incident happened.

Based upon the amount stolen, this appears to be a Class C felony, punishable by up to 5 years in prison. There is no mandatory minimum jail time, so he could conceivably get a suspended sentence , which means all (or a portion) of jail time is suspended for a period of time (at least 2 years) subject to compliance with probation requirements. The question I would have in making such a determination is was the $6500.00 stolen in a single lump sum, or was it stolen over a period of time. If it was the latter, then it appears that the pattern may have been to keep doing it until caught. This person should really consult with, and retain, the services of an attorney. This is very serious as a felony conviction may effect future employability, and if going to college, could impact loan, scholarship, and financial aid eligibility.
