The demand letter you got can be negotiated down because of your circumstances. It appears that from your story the cops were not called, if they were and you have to appear in court, you might be offered a deferred prosecution agreement.

What the civil Judge found is not determinative of whether the state can file theft charges.  The standard of proof on a criminal case is different.  However, the event can be reported to the police and/or the state attorney and they can decide if they think they can prove a criminal lheft of money.  I would contact a criminal defense attorney for a consultation and the attorney may be able to check to see if it is going any further.
