I was arrested in my home, the police jumped my gate came in with no permission and arrested me, is this a legal thing to do?

Answered by attorney Jason William Savela
Criminal Law lawyer at The Savela Law Firm, P.C.
Doubtful but the remedy is the question - basically what can we suppress? What evidence did they get from you during the arrest that they did not have already? What kind of case?

Can I sue if I was assault at a restaurant? How?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Criminal Law lawyer at Bulman Law Associates PLLC
You can sue the person who assaulted you and call the police and make a criminal complaint. They will probably decline to do anything now that time has passed. Suing him yourself will just expose you to more contact with the defendant. An 'all night dinner' sounds like an uncontrolled party. Why all night?

Is it a conviction if charges are dismissed?

Answered by attorney Steven Joseph Pisani (Unclaimed Profile)
Criminal Law lawyer at The Law Offices of Steven J. Pisani, LLC
This sounds like you accepted a deferred judgment and sentence from the court. A deferred judgment allows a defendant to plead guilty, complete some request of the prosecution and ultimately have the case dismissed. For most purposes, you may be able to state you do not have a conviction on your record. However, Colorado will view this still as a conviction until it is sealed from your record. Once it is sealed, you can legally claim that the case never existed.
