The law in Michigan is that a person with a criminal record of ONE, qualifying, conviction can apply to have that ONE conviction removed from his/her criminal history through an order of Expungement after the five year anniversary of the date of conviction. In your boyfriend's case, if he has no other convictions, he will have to wait 3 more yrs.before he is eligible to file for expungement.

Your use of the term "Class C" tells me that you're not in California. I would imagine, however, that other states handle public intoxication charges in a fairly similar fashion. In my experience, it is very common for cops to not write full reports for low-level offenses like public intoxication.

The police and school had every right to confront you based upon the nature of your text messages. As far as charges, she can file a complaint, but she cannot press charges. In criminal cases, whether charges are filed is entirely up to the prosecutor. Based upon your past relationship issues and the fact that the police and school were involved, I have to wonder why you would be so foolish as to get back into any form of relationship with her. If you have no dealings with her, she can't extort or blackmail you. Think about it. What happens to you is a consequence of the decisions you make.
