Generally, under the new law, a jail sentence (or jail time) is 50% of what is ordered, for good time/work time credits. So he would probably do 8 days or less. Depending on his charge and the jail, due to overcrowded jails, some are releasing some prisoners (with minor non-violent convictions) early. A misdemeanor conviction, although as stated above is not as serious as a felony, is still a criminal conviction and should be taken seriously as a misdemeanor conviction can have lasting effects including a criminal record, and potential employment issues.I would recommend consulting with an attorney in more detail about your case to discuss potential options in more detail. If your DUI convictions were only misdemeanors, then no, they would not change to a felony simply because there are 2 convictions. Most 1st and 2nd offense DUI's are misdemeanors, Unless there was an accident causing bodily injury on one or both of the DUI's.
