Potentially, if the drug treatment center recommends that he violated the conditions of drug treatment, then he could be looking at further prison time. But the fact that his next court date was moved up doesn't necessarily mean that he's going to be sentenced to 8 years in prison. It will probably review the court letter and determine whether he has violated the conditions of sentence.

I handle exclusively criminal defense matters. I do not know the answer to your question as a lawyer and would direct you to contact a personal injury lawyer. It is my gut instinct that you would not be able to sue the provoker of the fight as each person is assumed to have free will and your grandson took steps that led to a shooting. Good luck.

The answer to the "can I sue" question is at most times, yes for anything, however, not always successfully.  Are you sure it was the Dept. of Corrections that sent you back to jail, from your facts, it sounds more like it was the police making possibly a false arrest or at least an arrest based on faulty information.  There is not much of a civil law suit in these facts.  It sounds like the DA was not able to make a case and thus you were not convicted or charged with the crime.  Your only damages would be the time in jail, and while that is important to you, it would rise to enough to bring a successful suit.  However, this is in the criminal law section, a penal civil rights attorney may have a different answer for you.
