The best bet would be to hire an attorney to appear for you, saving you from missing school, and trying to arrange a way to have the offense dismissed. That way you can save the charge from going on your record.

Can a misdemenor assault case get dismissed and then refiled as a felony?

Answered by attorney Kenneth G. Wincorn
Criminal Law lawyer at Law Offices of Kenneth G. Wincorn & Associates, P.C.
The answer is yes. If there is a long delay before filing there may be a defense based on the statute of limitations. It is not unusual for a misdemeanor to be refiled as a felony when there was serious injury, very old or young complainants, a weapon used or other agrivating factors.
