Can I press charges against someone who stole my property without direct proof?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
No one has the ability to "press charges" except for district attorneys. What you should do is contact the police. They will take a report, conduct an investigation, and forward their findings on to the district attorney. Then the DA will decide whether to press charges or not. That's about all you can do. Another route you could try would be to sue the person in small claims court. Whether or not you have enough proof will be up to a judge to decide.

How can I prove to the judge that my wife exaggerated her story?

Answered by attorney Lori A. Beck
Criminal Law lawyer at Beck Law Office, LLC
This is what a trial is for. If you feel you are not guilty, you need to have a jury find you not guilty. A judge has no discretion to dismiss charges.
