If a person is filmed on video smoking a controlled substance. Can that person be charged for a crime?

Anthony S. Simpson
Answered by attorney Anthony S. Simpson (Unclaimed Profile)
Criminal Law lawyer at The Law Offices of Anthony Simpson, Esq.
Could a person be charged?  There is always a chance an officer would charge someone for video evidence of someone smoking.  However, to convict the state would have to prove beyond a reasonable that the substance was a controlled dangerous substance, and therefore would need other evidence than just the video.  Also, the video could be used as evidence of possession of paraphernalia, so it is best not to smoke your completely legal substances in a suspect smoking device on video.

MY BOYFRIEND WAS ARRESTED FOR CHILD INDECEY A MONTH AGO HOW LONG DOES IT TAKE TO FIND OUT WHATS GOING ON WITH CASE AFTER HE WAS BONDED OUT?

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
Criminal Law lawyer at The Law Office of Rick Oliver
It depends on the County in which the case is pending. In more rural Counties it could take several months for the courts to assign the case and give him a court date. If you're in a bigger County that process is usually much faster. The investigation that was done by police that led to charges being filed has already been mostly, if not entirely, completed. All the police need is probable cause in order to get an arrest. Nevertheless, often they will complete their investigation before referring the case to the DA. Other than court settings, the only thing that really matters is the investigation being conducted by the defense attorney. The scope of that investigation will largely depend, in my opinion, on whether your BF has admitted guilt, or is maintaining his innocence. These are really tough cases. If he can pull together the resources to hire an attorney and an investigator to aid in that investigation, he really, really should.

Is he looking at jail time if he was caught driving without a license in an unregistered vehicle?

Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
Evading a police officer can be charged as a misdemeanor or a felony (see PC 2800), driving without a license can be charged as a misdemeanor or an infraction (see VC 12500). Any misdemeanor carries the potential for jail time. The person facing these charges needs a lawyer.
