You can be subpoenaed and compelled to testify, by either the prosecution or defense. You cannot be compelled to incriminate yourself.

How do I find out what kind of warrant my husband has for a misdemeanor probation violation that is out of state?

You need to retain an attorney in the State where the warrant was issued. The best way to find an attorney is through a referral from a friend or relative. Otherwise, look through the yellow pages or google "criminal attorney" with the city and state.

He has an attorney, who knows the case and can answer your questions. None of us can, as we don?t know all the facts and details and discussions with the DA. Any such ?plea deal? is dependent upon the DA and judge agreeing. That deal is what attorneys are paid to do. If he is not satisfied with his PD deputy, he is free to hire a new private counsel or try to get the PD office to replace the current deputy for ?good cause?. No PD is able or willing to give ?hand holding? and personal attention to your case. They probably have a dozen or more cases on calendar every day. They will review the file before court and speak with you for a couple minutes in court. In general, if committed to psychiatric institutionalization, it would be for an indefinite time and he could be in longer before ?cured? than a straight prison sentence. But, there is a world of difference between a medical psych facility and a violent prison dominated by prison gangs. No sane person would choose prison just because it might be less time there. Besides which, you have not described a situation where I would expect my client to have to serve prison time if handled will by his attorney. If serious about hiring private counsel, feel free to contact me for the help you need.
