What can we do to avoid a statutory rape charge?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
Criminal Law lawyer at Austin Legal Services, PLC
Marriage will probably not stop charges from being filed. If she seeks governmental assistance, they can require her to seek paternity and child support as a contingency for receiving government benefits. If that happens, they would turn the matter over to the police and prosecutor to determine if charges should be filed. I would suggest being proactive and getting a lawyer involved now.

How should I proceed when my mother in law calls and leaves my wife and I messages that are threatening?

Thomas C. Bulman
Answered by attorney Thomas C. Bulman (Unclaimed Profile)
Criminal Law lawyer at Bulman Law Associates PLLC
Make sure your house remains crime free. The police might use her crazy rants to get a search warrant. Don't respond in kind to her vulgarities. Save all her messages. Carry a small video camera to prove you tried to walk away if she bushwacks you with a surprise confrontation. Be able to prove what horrible things she says and does. Eventually, you will get enough to get a temporary and then final restraining order at the Justice Court.

A criminal record is for life. If there is only one conviction, after 5 years, you could move to have it expunged.
