Can a judge allow me to go to the army instead of being put on probation?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
Criminal Law lawyer at Lawrence Lewis, P.C.
The army will NOT take you IF you have an open felony, a felony conviction, a felony probation, or an order from the judge that your case was dismissed in order to go to the army. That is the 1963 army, this is the 2016 army. They do not need delinquents in the Army, they have enough smart, athletic students, who need money for college that are willing to join the military. So, the judge cannot sentence you to serve in the military. The only thing the judge can do is dismiss the charges. The Army will not take you until the charges are dismissed, and the judge has no reason to dismiss the charges under the hopes that you will join the army.

What should I write to the judge to remove my warrant and what will happen next?

The clerk told you nonsense. You cannot write to have a warrant recalled. You can only write to get a court date to request a hearing. At the hearing, IF you are unsuccessful, then you will be arrested on the warrant.

If the IRS executes a search warrant on your home for a person or specific items and find something illegal, can they prosecute you for it?

Criminal Law lawyer at Musilli Brennan Associates, PLLC
If contraband was found in her home during a search then it is certainly possible that you could be prosecuted in either the state or federal level. It is very doubtful that the IRS would do the prosecution unless it is tax related.
