My daughter arrested in dekalb

Answered by attorney Evan Austin Watson
Criminal Law lawyer at Zeliff Watson Attorneys at Law
If your daughter is 17, she is considered an adult under Georgia law.  She will need to appear before a judge unless the particular crime she is charged with has a predetermined bond with it.

What does the letter that says people are ready for trial mean?

default-avatar
Answered by attorney Francis John Cowhig (Unclaimed Profile)
Criminal Law lawyer at Francis John Cowhig
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. There may be a warrant out for your arrest. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

Do I have a right as a defendant to see the police report of the assault charges are being put against me?

Answered by attorney Amanda Bowden Johnson
Criminal Law lawyer at The Houser Law Firm, P.C.
Generally, police reports are public record - so you should be able to get a copy however, there are some circumstances where reports are confidential by law. The police report is of limited value anyway - you were there, you know what happened and you have a witness - prepare your case on that. Besides, why are you so interested in your rights now when you already gave up one of your most important rights. The right to remain silent. Never ever ever under any circumstances whatsoever go and make statements to the police or any law enforcement for that matter. I know you think you want to go in and tell your side and clear your good name but as you can see - that doesn't happen. Prisons are filled with people who may not be there if they would have just kept their mouth shut. After grade school Officer Friendly isn't your buddy any more! There is a decent chance that had you not gone in and made the statements you did, nothing would have come of this. If you think about it logically, making statements to police who are investigating you is basically just plain stupid. Not that you personally are stupid but rather the act of making a statement to the police is a stupid thing to do. If the police had what they needed to make an arrest they wouldn't need to bother to question you. If police are questioning you, it generally means they don't have what they need and are hoping you will be stupid enough to fill in the blanks for them by answering questions - basically making statements to the police generally means you are screwing yourself. Since you didn't know even that most basic tenant of criminal law, you most likely do not possess the ability to properly represent yourself - so consider hiring a lawyer before you muck this up anymore than you already have.
