How can I get a felony expunged if I followed court orders?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
Nothing can be done to seal nor expunge this record. To be eligible for nondisclosure, the person must have successfully completed an eligible deferred adjudication probation and waited the proper time limit. Assaults involving family violence are never subject to nondisclosure thus even if you had finished the probaiton successfully, the case would not be subject to being sealed. To be eligible for an expunction, the case must have been dismissed or the person found not guilty, and then other requirements also apply.

What does collapsed cases mean?

Not sure what "collapsed" means - it is not a legal term. There is a time limit but if he has been out on bond, there is no time limit (except if his lawyer is able to claim that he has been prejudiced because of loss of witnesses or something.) Walker county moves very slowly.

What happens if I do not report to my probation officer?

Answered by attorney Mark R. Thiessen
Criminal Law lawyer at Thiessen Law Firm
You need to hire an attorney for the Motion to Revoke Probation and then that attorney can help turn him in if that's the right move. He absolutely needs to comply with all other terms of his probation and go to the next meeting. Call the probation officer and explain why you missed. Actually, hire an attorney first so they can advise you properly based on the County, Court and his history.
