My daughter call the police because his boyfriend was grabbing her by the hair, she pushed him back in self defense and called the police.

Answered by attorney Diane Buerger
Criminal Law lawyer at The Buerger Law Firm, P.A.
It is impossible to predict whether your daughter will be convicted of a crime based on the information you provided.  If your daughter pushed her boyfriend strictly to keep him from attacking her (e.g., pulling her hair), that would constitute self-defense.  However, there are restrictions on what can be done -- that is, to what extent -- in self-defense.  So it would appear that your daughter may have a self-defense claim -- but that does not mean she would win if the case proceeds to trial -- since her version of what happened does not match the boyfriend's version.  It appears the boyfriend's version would be in opposition to a claim of self-defense -- since he is claiming he never touched her.  Thus, if the case were to proceed to trial,  and if the judge or jury (depending which hears the case) finds it was legal self-defense, she should be acquitted.  However, if the judge or jury believes the boyfriend's story, she could be convicted.  There also are other ways, short of proceeding to trial, to try to resolve the case.  Any attorney you retain should be able to discuss what, if any, possibilities exist for deferred prosecution -- or the potential and ramifications of a plea bargain.

What does it mean if a criminal case is closed?

default-avatar
Answered by attorney John F Brennan (Unclaimed Profile)
Criminal Law lawyer at Musilli Brennan Associates, PLLC
It would have to examine the file to determine when it was closed, if it was before trial or plea it is generally indicative there is no PRESENT intent to continue the prosecution.

What does it mean if you plead no contest?

Answered by attorney Nathaniel D Shafer
Criminal Law lawyer at Natty Shafer Law
For most purposes, a no contest plea is the same as a guilty plea. It will show up on a criminal record. Legally speaking it means you are saying that if the prosecutor were to bring the case to trial, you would be found guilty, but you are not admitting you are guilty.
