A person can use force to defend against a physical attack even against a parent. The force must be reasonable and commensurate with the force necessary to defend against the assault. There is no such thing as 3rd degree battery or a 30 day maximum penalty in the State of Nevada.

First off, I suspect that you will loose your job, and quite possibly your nursing license. As far as charges: those could range anywhere from a felony to a gross misdemeanor. Under either classification, you could be looking at jail time. This is a very serious situation. While it sounds like you are guilty, an attorney may still be able to help you mitigate the situation. Consult with an attorney.

I can't practice law in New York, just California. I have seen evidence introduced in the form of a photo of a weapon, and the policeman who found it testifies this is the weapon he found. Seems it would be a jurisdictional issue in California if the accused indicated the knife was legal to possess. If it were legal, a motion should be brought before trial to demonstrate this. Need to know what about the knife or about the accused makes it illegal. The public defender should bring a motion in California if the knife is simply legal.
