The admissibility of the evidence in that particular situation would require a considerable amount of legal research. There are rarely black and white answers to legal questions, and you question is actually far more complex than it probably seems. My advice would be to hire a local criminal defense lawyer, or ask the court to appoint the public defender.

I don't know where you live, in California there is no specific prescription for a certain amount. That can be theft, possibly burglary if it was taken from your house . I have defended some cases where the defendant was charged with burglary from the house, but the victims never reported the drugs just other stolen property.
