Will a first offense for armed robbery get jail time or house arrest?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
The honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, expected testimony, priors history, etc. The charges actually filed by the DA will determine how much time and other penalties could potentially be imposed. You'll learn the actual charge[s] and any enhancements filed and get copies of all the police reports and prosecutors evidence when appearing for arraignment at the first court hearing. In California, if convicted of any felony, like armed robbery, you potentially face several or more years in prison, not house arrest.

Is it legal for police to take possession of vehicle for an open container and distributing to a minor when the owner of the vehicle is present?

Is it legal? You'll get the answer to that from the judge at the conclusion of an evidence return and/or evidence suppression motion if you have to file one to get back the car. It sounds like someone committed contempt of cop with their attitude to cause this, since it is not normal to impound the vehicle.

Can I have my DUI charge reduced?

Answered by attorney Carnell Johnson
Criminal Law lawyer at Johnson Nicholson, PLLC
In Charlotte, the DA will not reduce a DWI to a reckless driving charge. In surrounding counties, it is possible. Please note, however, that a .08 BAC is low, and can be challenged. The breathalyzer has a margin of error of +/- 5%, which in effect can reduce the .08 in a trial. Please feel free to contact me with more information about your case.
