How do I get my record sealed?

Thomas J Tomko

There is not a procedure to go back in time and "seal" a record. There is a procedure for expungement. If you have only one misdemeanor or felony conviction, after 5 years you can petition the sentencing Court to expunge the one conviction from your record, provided it is not an excluded offense. I hope that this was helpful.

How can I get my license back?

It depends. Did you demand a hearing with DMV? It sounds like there will be no direction for Safety classes from the court, therefore the issue of your license should be taken up with DMV.

Can I be charged with possession for drugs found lying on the street?

Technically, you can be charged with anything. Whether or not the D.A. can prove the charges is another thing. If you have not done so already, I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. He/she would then be in a better position to analyze your case and advise you of your options.
