What happens to a second time offender of driving with a suspended license?

Answered by attorney Steven Fairlie
Criminal Law lawyer at Fairlie & Lippy, P.C.
That depends on a bunch of different factors like whether it was suspended for DUI and whether you were intoxicated at the time. You will need to talk with a lawyer to get a solid opinion.

Why would a criminal threats case be dismissed then refilled immediately?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
You'll get your answers about what and why they did things, but only when your attorney gets the discovery files in court at your arraignment. Once you have all the pleadings and police reports, then your attorney can determine if there are grounds for evidence suppression or other motions, or defenses to use in the case. Without knowing all those factors, any opinion would be worthless speculation. It is the policy of law enforcement and prosecutors to vigorously prosecute domestic violence charges, even over the objection of the victim. Once police are called, someone is going to jail in cuffs. Prosecutors do not drop charges just because the poor tearful victim recants and pleads for mercy for her repentant and sorry breadwinner. The system is tired of frequently seeing that victim later beaten to a pulp or killed by the same abuser. That is the attitude you are facing.
