Just appear in court where the warrant was issued, go to the clerk's office give his name and advise them that he wants to walk in on his warrant and appear before a judge to have the warrant recalled. Once he is in court to request that a public defender be appointed to represent him.

I suppose the best answer to your question is that he should do NO TIME in jail if there is not sufficient evidence that he was involved in the crime. Many times, however, the District Attorney will try to say that?the Defendant is involved in a conspiracy (agreement with others) to commit a crime, and that he should be punished just the same as if he had taken criminal actions (stabbing, shooting, or assaulting etc.) So what you have to learn is what exactly is the DA trying to prove: certain actions of Defendant, or his apparent agreement, or making a plan with others to commit the crime.? This is why you need an experienced criminal defense Attorney to find out why the DA will try to prove, and plan his defense that will defeat this at Trial. This is a complex matter involving not only many items or possible proof/testimony, but also the applicable evidence that will be used by the Court to either admit or deny evidence.? Therefore, get an experienced Attorney to advise him, because his life and future are at stake.

Hard to say. The DA has discretion to file or not to file and? they can push for jail, or prison, or straight probation without jail or prison. The fact that there is no loss means you have a chance at a lower punishment. Trying it twice may be a factor on the other side of the issue. You need a lawyer.
