If you engage in any kind of sexual activity such as making out, petting or any kind of foreplay, not to mention intercourse, then you can be charged with sexual abuse and endangering the welfare of a child, at least. A sixteen year old is incapable of legal consent for any of that.

There is a right to appeal in all criminal cases, unless the right to appeal was waived (which only applies to some plea bargains). There are time limits as to how soon a notice of appeal may be filed after judgment, so if you want to have an appeal filed, make sure his attorney is aware. You should have a discussion with his attorney about these issues anyway. You're going to get far better information from the attorney that has been involved in the case.
