Can a misdeamor be changed to a felony?

Answered by attorney Gabriel Eric Dorman (Unclaimed Profile)

A crime that can be charged as either a misdemeanor or a felony is known as a "wobbler". To answer your question, yes, a misdemeanor can be charged as a felony if that crime for which you have been arrested is a wobbler. Whether or not a wobbler is charged as a misdemeanor or felony depends on a large number of factors including, but not limited to, the type of crime, the facts of the case, any injuries to other parties, prior convictions for the same offense, the amount of monetary loss (for theft and fraud crimes), etc., etc., etc. The ultimate decision on how to file a wobbler is up to the prosecuting attorney's office. I hope this answer was helpful. Good luck.

While this burglary charge stick if we had permission to be in the house?

Answered by attorney Lucio Antonio Montes (Unclaimed Profile)
Criminal Law lawyer at The Montes Law Firm
Assuming your friend had permission, it will not likely stick as a burglary charge. Burglary is basically trespassing with the intent to commit another crime such as an assault or a theft. You should consult with a local criminal defense attorney. Criminal defense attorneys usually offer a free 20 to 30 minute consultation. Good luck.

When can a warrant be lifted?

Cynthia Russell Henley
Answered by attorney Cynthia Russell Henley (Unclaimed Profile)
Criminal Law lawyer at Cynthia Henley
A blue warrant is for a parole violations - there is no judge involved. So, if she is on probation and parole and worked out her issues with probation that does not mean parole agrees. Until there is an action on the parole matter - whether dismissal or other punishment - the blue warrant will stay and she will not be released.
