It is probably not possession, but it could still be theft if his record is clean, its unlikely he would get a jail sentence, but he may end up with a criminal charge - likely misdemeanor.

Think about your question. How did law enforcement learn that you had sex with your girlfriend? Her parents probably informed police. Why? Because they want you to pay for having sex with their baby. If that is true, then your girlfriend will have no say in the matter. Can the charge get dropped? Sure it can. But why would the prosecutor dismiss a slam dunk case. You were over 18, she was under 16, that means guilty, and sex offender registry. Good luck.

The facts as you have stated them is not shoplifting. No merchandise found on you.  You were trying on shoes which you had a right to do.  Where were the purchase tickets showing the price of the shoes?  on the shoes, or somewhere else?
