If you have already been convicted then a jury found there was sufficient evidence to convict you.  The review on appeal will be whether there is any credible evidence to uphold the verdict using the standard found in JANCKSON V VIRGINIA.  The police should not be allowed to testify to hearsay statements made to them outside of your presence.  Therefore, if the woman does not show up for Court, whatever she told the police would be inadmissable hearsay.

You weren't necessarily illegally searched. If he smelled marijuana, he will argue to the Court that there were "exigent circumstances" to justify the search but many judges will disagree and suppress the search.

I suggest, as I always do, that your son have a lawyer with him when he talks to the cops. That will upset them no duubt; they hate it when lawyers get involved. But it is the best protection for your son. The lawyer may be able to contact the investigators in advance of the interview and confirm that he is a witness only and not a suspect. Unless that commitment is made by the investigators I rarely let a client speak to them. That one call to the investigator has given me and my client important information and has saved a client more than once from making a statement from the cops that would have incriminated them and surely allowed the prosecution to have filed charges.
