My advice is for you to contact an experienced immigration attorney with a AV or higher rating here on martindale hubbell. the immigration attorney will know the steps to take in order to take advantage of your husbands status as a victim of a shooting.  At at this point you do not need a criminal attorney.  I don't think it's too late. But waste no more time. See a qualified immigration attorney with a good rating and good client reviews here on Lexis and Martindale Hubbell.  Best of luck to you.

I am assuming that you are talking about a State Jail felony, as Texas no longer has and does not have Fourth Degree Felonies. If you are talking about a State that is not Texas this answer does not apply as the rules for each State are different. The answer to this question depends on how your case was resolved. If you were on supervised probation (community supervision) or on supervised deferred adjudication, the answer is no. If you served prison or state jail time, the answer is also no, as serving time means you were convicted of the offense. If, however, your case was dismissed then you may be eligible for an expunction depending on when the Statute of Limitations runs.
